The questionnaire is a simple multiple-choice format and allows you to complete either just an LPA-PA, or an LPA-PA plus an LPA-HW.

When you've completed the questionnaire, all you then have to do is check the Summary, Pay, Download, Print and Sign.

A ‘Lasting Power of Attorney - Property & Financial Affairs’ (‘LPA-PA’) allows you to appoint somebody to look after your money and property and other related affairs if for any reason you become unable to manage them yourself e.g.

As current legislation stands, if somebody has to go into long term care the Local Authority has the power to seize all but £23,250 of their assets as a contribution towards the cost of that care.

Up until April 2015 that included being able to force the sale of their home, but from April 2015 (under a new ‘Universal Deferred Payments Scheme’, intended to prevent anyone from having to sell their home in their lifetime to pay for residential care) local authorities will instead be able to take an interest-bearing charge on the property of an individual against the cost of care fees, to be repaid after the individual’s death. Interest will be chargeable throughout the lifetime of the deferred payment.

So, whilst your home will not be sold while you are alive, its value will still be used to pay for your care costs - preventing you from being able to pass it on to your loved ones.

This issue is real: Official government statistics show that the some 69,000 homes each year have their equity used to fund long term care (which is equivalent to one home every four minutes).

If you are a couple and you jointly own your home then your home is at risk of being taken from your loved ones once you have both passed on, sold, and used to pay for the costs - plus interest - of your long term care.

However, you can easily protect at least 50% of your home by making a pair of Protective Property Trust Wills.

For ease of reading we shall from now on refer to the LPA-PA and LPA-HW as if you were making them as ‘one person’, but what follows is also valid for ‘two people’
 

How do I make an LPA-PA and/or an LPA-HW?

We take all of the pain out of the process of drafting an LPA-PA and/or an LPA-HW, condensing it into a few simple questions for you to answer and then creating your document(s) for you based on your answers.

  • Once you've completed the online questionnaire (which can take as little as 3 minutes), you're given the option to purchase the LPA-PA (and, if you’ve drafted one, the LPA-HW - or just one or the other).
  • You then download and print the document(s) and get them signed (by you, your Attorney(s), and your 'Certificate provider'). We provide you with very detailed and personalised instructions for doing this step.
  • Finally, an LPA cannot be used until it has been registered at the Office of the Public Guardian (the 'OPG').
    There is a fee to pay to the OPG (not to us) for this of £82 per LPA-PA or LPA-HW.
    If you are on low income or benefits or in some similar situation, you may be able to apply for a 50% or even 100% reduction of this fee. See here for further details.
    Registering the LPA(s) is your responsibility (although to help you we make blank registration forms available for download from our website) and can be done at any time between the LPA being made and the moment that it is required to be used. Therefore the registration fee is not a cost you need to incur straight away - indeed if the LPA is never required to be used then it need never be incurred at all.

So how do I actually start?

This depends on whether or not you've already used our service :-

(a) If you've already made a Will at our site, login and select the 'Make a Lasting Power of Attorney - Property and Financial Affairs' option.

(b) If you haven't used our site before, you have 2 options: -

What if I only want to make an LPA-HW?

If you just want an LPA-HW and not an LPA-PA:-

  1. Take either option (a) or option (b) above as appropriate and draft both an LPA-PA and an LPA-HW.
  2. When you get to the point of purchase, de-select the LPA-PA - this will allow you to purchase the LPA-HW only.

What about the Enduring Power of Attorney (EPA)?

You can no longer make (or amend an existing)(an) Enduring Power of Attorney. However, if you made one before October 2007 and it was correctly signed and witnessed then it is still perfectly legal and valid. You will find a detailed description of the differences between an EPA and an LPA here.
